Ecuadorian Flowers Stay Duty Free -- For Now PDF Print E-mail

As of today, it appears as if flowers exported to the U.S. from Ecuador will continue to enjoy duty-free status through the end of 2009. Last year, under the Andean Trade Preference and Drug Eradication Act (ATPDEA), Congress extended duty-free access to U.S. markets for flowers coming from Colombia, Ecuador, Bolivia and Peru through December 31, 2009. At the same time, however, Congress added a qualifier by saying that Ecuador would continue to enjoy duty-free access unless the President Obama determined before June 30, 2009, that Ecuador was not meeting the Act's eligibility requirements.

Currently we are not aware of any intent within the Administration or Congress to deny duty-free access for Ecuadorian flowers. With that said, deadlines have a way of focusing the attention of politicians and regulators, so things could change. Stay tuned to Capitol Letters and we'll keep you in the loop.
